Similarity (Article 4, paragraph(1), item(11) of Trademark Act)
(Conclusion:)
The Trademark should not be judged as similar to the JPO-Cited Trademark.
The JPO-Cited Trademark consists of “SEIKO”, which is the abbreviation for the products or trade name of a well-known manufacturer and seller of watches and clocks in Japan, and “EYE”, which is a general, common term closely related to eyeglasses. Thus, no pronunciation or concept arises from the “EYE” part of the JPO-Cited Trademark which designates watches and eyeglasses. Therefore, the Trademark is not similar to the JPO-Cited Trademark in view of appearance, pronunciation and concept.
